HIV-positive Canton man gets 3 years in prison for having unprotected sex with 16-year-old


CLEVELAND, Ohio - A 57-year-old Canton man was sentenced to three years in prison Wednesday for having sex with a 16-year-old knowing that he was HIV positive.

Kenneth Sander was initially charged with rape and felonious assault of the young man, whom he believed to be 18 at the time. He pleaded guilty to one count of felonious assault on Feb. 23.

Cuyahoga Common Pleas Judge Brendan J. Sheehan handed down the sentence. 

Ohio forbids anyone who is HIV positive from having sexual relations with anyone younger than 18, regardless of whether they inform the person of their condition.

Several of Sander's friends and family showed up to testify on his behalf. They told the judge Sander was a good father to four children, including two adopted sons. They said he is the type of person who is always ready and willing to help. His ex-wife also testified, saying that he was the better parent of the two.
